Aircraft dry leasing and the commercial exemptions found in the FARs can be beneficial operating tools. However, a lack of understanding (or even an intentional disregard) of proper structuring has resulted in a major crackdown by the FAA and the Internal Revenue Service on alleged “illegal charter” operations. This session will outline the necessary elements for dry leasing, time-sharing, interchange agreements, and demonstration flights; examine enforcement litigation involving alleged violations of regulatory exceptions; and discuss the range of resulting sanctions. Participants will learn how to avoid inadvertent and costly violations associated with illegal charter operations.
